Registration of industrial designs

Industrial design registration is a legal process that provides protection for the visual appearance of a product or article. This includes the shape, configuration, pattern, ornamentation or any combination of these features. Registering an industrial design in Ukraine provides the owner with the exclusive right to prevent others from making, using or selling any product that incorporates the registered design without their permission.

The registration process for industrial designs in Ukraine involves filing an application with the Ukrainian Patent and Trademark Office (UKRNOIVI). The application must include the following information:

  1. A description of the design.
  2. Drawings or photographs of the design from different angles.
  3. The name and address of the applicant.

How to start?

Once the application is submitted, it will be examined by the UKRNOIVI to ensure it meets the requirements for registration. If the application is approved, the design will be registered and published.

The main benefit of registering an industrial design in Ukraine is that it gives the owner exclusive rights to prevent others from making, using or selling any product that incorporates the registered design without their permission. This can help businesses protect their unique product designs from being copied by competitors, giving them a competitive advantage in the market. Additionally, registering an industrial design can also increase the value of a business, as it shows that the business has invested in protecting its intellectual property assets.

It’s important to note that not all designs are eligible for registration in Ukraine. Designs must be new and possess an individual character to be eligible for protection. In other words, they must be distinct from existing designs and have a unique appearance.

If you as a foreign applicant wish to register an industrial design in Ukraine, you can either file a national application directly with the UKRNOIVI or enter the national phase of an International Application (Hague System) designating Ukraine. Our law firm can assist with the entire process, including translation services if necessary.
