On 10.07.2024, Kyiv hosted the conference “Defence Tech: Legal Challenges for the Industry“, organized jointly by Polikarpov Law Firm and AVELLUM. The event brought together company founders, investors and corporate lawyers to discuss current legal challenges and solutions for the development and scaling of the defence technology sector in Ukraine.

We addressed

  • Critical legal issues for defence companies in Ukraine, including intellectual property strategy;
  • Setting up and establishing a holding structure in accordance with export control requirements;
  • Regulation of relations between founders and investors, defence procurement and consequences of violation of defence legislation.

During our first discussion on intellectual property, Anton Polikarpov and Anastasia Shevchuk of Polikarpov Law Firm in cooperation with forensic expert and patent attorney Serhiy Petrenko presented mechanisms for protecting intellectual property to ensure security and support innovation in the defence industry.

We discussed

  • Protection of trademarks, industrial designs, inventions and copyrights;
  • Use of international systems, such as the Madrid Protocol, to simplify and speed up the process of registering trademarks abroad;
  • Contracts, including licensing and non-disclosure agreements (NDAs), which are essential for the protection and commercialization of know-how in the defence industry.

It was a great event for the rapidly developing military-technical industry in Ukraine. Special thanks to our colleagues from AVELLUM (Mykola Stetsenko and Andriy Romanchuk ) for their impeccable teamwork.
