PUBLIC SERVICE AGREEMENT (OFFER)

(Terms of Service — Polikarpov.legal platform)

This Public Service Agreement (hereinafter — the “Agreement”) is an official public proposal by the Service Provider, addressed to any person (individual, sole proprietor, or legal entity), hereinafter — the “User”, to enter into this Agreement for the provision of information, analytical, and intermediary services related to trademarks (TM) under the terms set forth below.

The Agreement is public in accordance with Articles 633, 641 of the Civil Code of Ukraine. In accordance with Article 642 of the Civil Code of Ukraine, full and unconditional acceptance (acceptance) of the terms of this public offer constitutes any action by the User directed at using the Website, filling out search forms, ordering a consultation, completing the registration quiz, or making payment for the “TM Analysis” service.

1. Terms and Definitions

• Service Provider — Advocate Polikarpov, practicing advocates, patent attorneys, and/or business entities operating the Polikarpov.legal platform and providing services to Users.
• User — any legally capable individual, sole proprietor, or legal entity who has visited the Website and/or used any of the Platform’s services.
• Website (Platform) — a set of web pages published on the Internet at polikarpov.legal and its subdomains: search.polikarpov.legal (Free Search), analysis.polikarpov.legal (Paid Analysis), quiz.polikarpov.legal (Registration Quiz).
• Free TM Search — a free service for automated express search of identical or similar trademarks in public registries by TM name, provided to the User with a limited number of attempts.
• TM Analysis (Detailed/Deep Analysis / Expert Report) — a paid service for automated in-depth verification of a trademark against databases, including assessment of registration chances as a percentage (%), identification of similar marks (phonetic, visual, semantic similarity), and generation of an analytical report in electronic form (HTML and PDF).
• TM Registration Quiz — a step-by-step interactive form for collecting necessary data from the User for subsequent preparation and submission of a TM registration application to the Ukrainian patent office.
• Legal Consultation — an information service provided by the Service Provider’s lawyers or patent attorneys verbally (by phone) or in writing based on data received from the User via Platform forms.

2. Subject Matter of the Agreement

The Service Provider undertakes to provide the User with services (free or paid) in accordance with the Platform’s functionality and the User’s chosen scenario, namely:
1. Provide the ability to conduct a Free TM Search within established limits.
2. Provide the service of generating an automated “TM Analysis” report after payment is made.
3. Provide verbal/written consultation upon User request.
4. Ensure preparation and support of the TM registration process through the Quiz under separately agreed tariffs.

3. Rules for Using the “Free TM Search” Service

1. The “Free TM Search” service is provided to the User in real time “as is”. It is designed exclusively to identify direct graphic and text matches (identity).
2. Users are provided with a limited number of free TM search attempts in accordance with the Platform’s current terms of use. The session is tracked using technical identification means.
3. After the free search limit is reached, access to the search is blocked. To resume interaction, the User may fill out a feedback form to receive a consultation or purchase the “TM Analysis” service.
4. Abuse protection: The use of any automated tools (scripts, bots, crawlers, parsers) for submitting requests to the search database is strictly prohibited. The Platform uses automated verification tools for invisible validation of request legitimacy and blocking of suspicious activity.

4. Procedure for Providing the “TM Analysis” Service (Paid Report)

1. To receive the detailed “TM Analysis” report, the User fills out a form (TM name, business description, Nice Classification classes) and makes 100% advance payment through the integrated LiqPay payment system.
2. The official product name in payment documents is “TM Analysis” (in marketing materials, synonyms may be used: deep analysis, detailed analysis, expert report).
3. The report generation process starts automatically upon the Service Provider’s server receiving confirmation of a successful transaction from the LiqPay payment system.
4. Report generation is an asynchronous process and typically takes 1 to 3 minutes. The User can observe the generation stages on a personal analysis results page. Closing the browser tab does not stop generation — the completed report will be sent to the User’s specified email address in any case.
5. After generation is complete, the report becomes available on the Website as a structured HTML document, and a PDF version is automatically sent to the User’s email.
6. Technical failures:
   • If payment was successful, but HTML report generation failed, the User has the right to initiate re-generation using the “Try Again” button or contact the support line.
   • If the HTML report was generated successfully, but delays or errors occurred in the formation or delivery of the PDF file, the service is deemed properly provided since the User has full access to the web version of the report. PDF re-generation is carried out by technical support without additional charge upon the User’s request.

5. Service Cost and Payment Procedure

1. The cost of the “TM Analysis” service and related registration services is published on the relevant Website pages immediately before the moment of ordering.
2. All payments are made in the national currency of Ukraine — hryvnia (UAH) by non-cash transfer via LiqPay.
3. The “TM Analysis” service is an information-computer product of individual one-time generation. Given that service performance begins instantly after payment, refunds for successfully generated reports are not provided.
4. If payment was debited but the service returned a debit error or the payment status is in a pending confirmation state, the Service Provider conducts a manual payment verification. If debit is confirmed without service provision, the Service Provider either activates report generation manually or issues a refund to the User’s card within 5 business days.

6. Intellectual Property

1. All Website elements (texts, designs, logos, interfaces, codes, databases, verification algorithms) are objects of the Service Provider’s intellectual property rights and are protected by Ukrainian law and international treaties.
2. The User is granted a limited, personal, revocable license to use the results of the Free Search and paid “TM Analysis” report exclusively for personal or internal business purposes.
3. It is strictly prohibited to copy, distribute, resell, or publish the “TM Analysis” report under one’s own name, or to use its structure or design to create competing services.

7. Limitation of Liability (Important Disclaimer)

1. Algorithmic nature: The results of “Free Search” and “TM Analysis” are generated automatically by specialized algorithms based on open trademark registries and applications. They reflect a similarity assessment and the probability of TM registration based on mathematical and logical data comparison methods.
2. Not an official decision: The Platform’s automated reports are not an official opinion of the State Organization “Ukrainian National Office of Intellectual Property and Innovations” (Ukrpatent / NIPO) or any other government authority.
3. Not a final legal guarantee: Analysis results are purely advisory in nature. No probability indicators (even at 100%) guarantee unimpeded TM registration by the government authority, as the final decision is made by a qualified government expert of NIPO following a detailed substantive examination, which may include subjective assessment criteria (consumer perception, reputation, etc.).
4. Input errors: The Service Provider is not liable for the inaccuracy or incompleteness of verification results if the User made errors when filling out the form (misspelled a word, selected inappropriate Nice Classification classes, or inaccurately described the business area).
5. Third-party systems: The Service Provider is not liable for technical disruptions in the operation of government TM databases, delays from the LiqPay payment system, or failures of internet providers and cloud services.

8. Term and Termination of the Agreement

1. This Agreement enters into force from the moment the User accepts (begins using the Website or makes payment) and remains in force until the parties fully fulfill their obligations.
2. The Service Provider has the right to make changes to this Agreement without prior notice to the User. The new version of the Agreement is published on the Website and enters into force from the moment of publication.

9. Dispute Resolution and Contacts

1. All disputes and disagreements arising in connection with the performance of this Agreement shall be resolved through negotiations.
2. If agreement is not reached, the dispute shall be resolved in court in accordance with applicable Ukrainian law.
