Trademark protection and registration in Ukraine

Technology & Communications & Media

Client: Cooley LLP (USA) — legal counsel for Vivino Inc.

Trademark Owner: Vivino Inc. — a global platform for wine ratings and recommendations, known for the Vivino mobile app

Legal Support Area: Trademark protection and registration in Ukraine

Project Summary

Since 2022, Polikarpov Law Firm has provided legal support to Vivino Inc. in Ukraine in collaboration with Cooley LLP. In October 2022, we filed a formal opposition against an international trademark application for “Vivino” submitted under the Madrid System by an unrelated Russian applicant.
As a result of our opposition, the Ukrainian IP Office refused the registration.
Subsequently, in 2023, we filed two national trademark applications for Vivino on behalf of the rightful owner — and both were successfully registered in Ukraine.

Client’s Goals

  • Prevent unauthorized trademark registration by unrelated third parties
  • Secure national protection of the Vivino brand in Ukraine
  • Ensure brand exclusivity as part of the global IP strategy

Project Complexity

  • Acting promptly against a Madrid-based filing by a bad-faith Russian applicant
  • Protecting brand identity before securing a local registration
  • Managing filings and examination to achieve smooth national registrations

Polikarpov Law Firm’s Actions

  • Filed and substantiated an opposition to the unauthorized application (2022)
  • Represented the client in opposition proceedings before the Ukrainian IP Office
  • Filed two national trademark applications for Vivino in 2023
