Polikarpov Law Firm represented medi GmbH & Co. KG in a trademark matter concerning the Ukrainian trademark application “Medi Go” in Class 10. The main issue was the presence of the dominant element “Medi,” which posed a likelihood of confusion with our client’s well-known MEDI brand in the field of orthopedic and compression medical products.
Our objective was clear: to eliminate potential market confusion by removing overlapping goods from the application while avoiding formal opposition proceedings. This approach would protect our client’s brand distinctiveness efficiently and cost-effectively.
Our initial investigation revealed that MediGo LLC was a new market entrant with no prior trademark portfolio or market activity. The absence of actual use of the “Medi Go” mark, combined with the similarity of distinctive elements and goods, positioned us strongly for potential opposition proceedings, with an estimated 75% chance of success. However, we opted for an amicable resolution strategy.
Through constructive negotiations with the applicant’s representative, we successfully secured a voluntary limitation of the trademark specification. The applicant agreed to exclude all conflicting Class 10 goods, particularly orthopedic bandages, compression wear, and anti-varicose stockings. This amendment was formally recorded prior to the opposition deadline, successfully achieving our client’s objectives while maintaining positive business relations.
